Facts
Walter and Violet Williams (plaintiffs) purchased property from Julia Polgar (defendant), at which time Polgar furnished an abstract of title. The abstract incorrectly omitted a deed from the chain of title. As a result of the error, the Williamses were obligated to remove a building from the property. The Williamses brought suit against Polgar and American Title Insurance Company (American) (defendant), the successor in interest to the original abstractor. The trial court found that the statute of limitations began running as of the execution of the land contract and granted judgment to Polgar and American. The Williamses appealed. The appellate court reversed and remanded. American requested leave to appeal to the Michigan Supreme Court, which was granted.
