This lesson will cover issues related to the burden of proof, the rules of evidence, and a noncitizen’s limited right to counsel at removal hearings.

Although immigration admission procedures typically involve the filing of standardized forms, removal procedures involve more litigation-type procedures that are akin to civil and criminal procedures. However, the constitutional protections afforded to noncitizens in the removal process resemble the more limited protections for civil litigants than the more extensive procedural protections given to criminal defendants.
